How the winner will be selected?

The top 10 most viewed videos will then be reviewed by the Wizz panel, which will select its top 3 based on creativity, storytelling, and authenticity.

Participants must have between 13 & 25 years old and live in the United States, Canada, United-Kingdom or Australia.

This contest (“Contest”) is sponsored by VLB, registered at 12 Place Dauphine, 75001 Paris, France (“Wizz”). 

Contest entry is free of charge. No purchase is necessary to enter or win. Making a purchase on the Wizz App does not increase your chances of winning. 

Wizz may offer similar contests from time to time. Each offer is separate. Entry into each contest is separate. 

This Contest is in no way sponsored, endorsed or administered, or associated with, TikTok. 

1. Organization 

The contest begins at 9:00 AM EST on March 10th, 2023. Participants must submit their entries before 11:59 PM EST on March 26th, 2023 (“Participation Period”).

1. Eligibility 

The Contest is open only to legal residents United States, Canada, United-Kingdom and Australia who have an Eligible Wizz Account. An “Eligible Wizz Account” means a Wizz App account that has successfully completed identity verification steps.

Participants must be over the age of thirteen (13), and under the age of twenty-five (25), when registering for the contest. Participants who are considered minors in their state of residence (“Minor”) must get their parent or legal guardian’s permission to participate in the Contest. A Minor Participant will be required to provide parental consent in a form satisfactory to Wizz before they can be declared a winner and any prize can be awarded under these Terms. Employees of Wizz and its parent, affiliates, subsidiaries, and advertising and promotion agencies involved in the Contest, and their immediate family members (parent, child, spouse, sibling and their respective spouses, regardless of where they reside) are not eligible to participate in or win the Contest. This Contest and its Terms are void where prohibited by law, and all federal, state and local laws apply. 

Eligible participants shall be referred to as “Participant(s)”. 

1. How to Enter 

Entry does not require a payment or a purchase of any kind. 

To enter the Contest, the Participant must have a Tiktok account. If you do not have a TikTok account you may create one for free by visiting www.tiktok.com. By submitting your information and creating an account, you agree to the terms of use and privacy policy of TikTok. If you do not agree to such terms of use and privacy policy, you cannot create an account or participate in this Contest. Wizz may not receive Participations from TikTok users with "private" updates (i.e., Participant has set his or her account so that only people the Participant has approved can view his or her updates.) If Participant is using his or her mobile device to enter, charges, including message and data rates, may apply. Participants should consult their wireless service provider regarding its pricing plans. 

The Participant must: 
1. Follow the “Wizz_app” Tiktok account (https://www.tiktok.com/@wizz_app), 
2. Create and upload a video on its TikTok account, with the hashtag #wizzcontest & #wizzapp, showing your experience on the Wizz App (the “Video”).

One Participant may post a maximum of fifteen (15) Videos. Only the Video with the proper hashtag will be considered. 

Content of videos

The Video content must not 

• include vulgar language or reference to religion or politics

• include any kind of sexuality or nudity

• include words or action related to racism

• be hurtful regarding sexuality, orientation and/or religion;

• include content that denigrates VLB and VLB Affiliates’ name, brand, or products. 

The Participant can only send his/her own Video(s) and cannot send a Video of someone without his/her authorization. 

Any Video which violates the rules set out by this agreement shall be excluded from the competition.

1. Designating the winners 

Three (3) winners will be selected, from amongst all eligible entries received, on a two-part selection basis: 

(i) At the end of the Participation Period, the ten (10) videos with the most amount of views (with a minimum of 50k views on the video) will be selected for review (as identified by the third-party platform Trendpop). (the “Selected Videos”)

(ii) A panel made of Wizz employees will review the Selected Videos, and will choose the top three (3) Videos. Videos will be evaluated on creativity, storytelling, originality and authenticity.

Winners will be notified on March 27, 2023 via direct message from @wizz_app on TikTok. The potential winner(s) will be asked for an eligible email address and will then be notified by email and may be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity (where legal) form within seven (7) days of the date of attempted notification. If winners are Minor, all documents must be signed by a parent or legal guardian. Noncompliance with this time period, with these Terms or the failure to respond to any prize/prize notification may result in disqualification and, at Wizz’s discretion, an alternate potential winner may be selected. 

Prize will be fulfilled approximately thirty (30) days after winner validation. Any winner later determined to be ineligible may be required to return his/her prize. Any taxes on prizes are the responsibility of the winner. 

1. Description of the prizes

One prize, in app, will be awarded: A Lifetime Wizz Gold Subscription.

The prize mentioned in the Contest offer is the only prize available. No transfer, substitution, or cash redemption will be awarded in lieu of the stated prize except by Wizz who reserves the right to substitute a prize of comparable or greater value, in its sole discretion, if the advertised prize becomes unavailable. All prize details are at the sole discretion of Wizz.

1. General Rules

Wizz values the Participants’ creativity and their time. As such Wizz acknowledges the Participants’ rights in and to the content created. By entering into the contest, Participants consent to provide a royalty-free, irrevocable, worldwide license, for commercial purposes to use the Participant’s name, city, state, likeness, voice, and submitted video during the Contest, for the lifetime of the rights granted under these Terms, without additional compensation, notification or permission, unless prohibited by law. Wizz shall have the right to copy, reproduce, fixe, modify, adapt, translate, reformat, publicly perform, publicly display, or otherwise transmit the Participants’ submissions. 

By participating, Participant (i) agrees to release and hold Wizz, and its parent, affiliates, subsidiaries, and advertising and promotion agencies, and each of their respective directors, officers, employees and assigns (collectively, the "Released Parties"), harmless against any and all claims and liability arising in whole or in part, directly or indirectly, out of participation in the Contest or misuse, nonuse or use of any prize; (ii) waives all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to enter; and (iii) agrees to be bound by these Terms. 

Released Parties are not responsible for incomplete, lost, late, damaged, inaccurate, illegible, misdirected, garbled, delayed or undelivered entries or referrals; or for technical hardware or software malfunctions or failures of any kind, lost, unavailable network connections, or failed, incomplete, garbled or delayed computer transmission, which may limit an individual's ability to participate. 

Wizz reserves the right in its sole discretion, to cancel, suspend or modify the Contest, or to disqualify any implicated entrant(s) (and their entries) if any fraud, virus, actions by entrants, technical or other error or problem, or any other occurrence corrupts or affects the administration, integrity, security, or proper play of the Contest, as determined by Wizz in its sole discretion. In the event of cancellation, Wizz reserves the right, at its sole discretion, to award the prize in a random drawing from among all eligible, non-suspect Participations received up to the time of the event or action warranting such cancellation. In the event the Contest is canceled prior to the stated end date, a notice will be posted at https://www.tiktok.com/@wizz_app 

Wizz may disqualify Videos if the Video and related tag includes inappropriate, offensive, or other derogatory language or information. Wizz reserves the right to remove, reject, or disqualify (along with the entrants who submitted them) any Video or related tag which, in its opinion, (a) violates any of these Terms, the terms of service and privacy policy of TikTok or Wizz App, (b) infringes, misappropriates, or violates any rights of any third party including, without limitation, patent, copyright, trademark, trade secret, or right of privacy or publicity, or (c) is otherwise inappropriate for inclusion in the Contest. 

1. No Warranties

Wizz makes no warranties covering any of the prizes furnished as part of this Contest. Any prize, and all materials furnished as part of or in connection with this Contest are provided "as is" without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose.

1. Disputes and Governing Law 

By participating in the Contest, each Participant agrees that to the extent permitted by applicable law: 

1. any and all claims, disputes and causes of action that cannot be resolved between participant and any releasee arising out of or connected with the Contest, or any prize awarded, will be resolved individually, without resort to any form of class action, 

2. Any and all claims, judgments and awards will be limited to an actual third-party, out of pocket costs incurred (if any), not to exceed ten (10) dollars USD, but in no event will attorneys’ fees be awarded or recoverable, 

3. under no circumstances will any Participant be permitted to obtain any award for, and Participant hereby knowingly and expressly waives all rights to seek punitive, incidental, consequential or special damages, lost profits and/or any other damages, other than actual out-of-pocket expenses not to exceed ten (10) dollars USD, and/or any rights to have damages multiplied or otherwise increased, and

4. Participant’s remedies are limited to a claim for money damages (if any) and Participant irrevocably waives any right to seek injunctive or equitable relief. 

Any dispute arising under or related hereto (whether for breach of contract, tortious conduct or otherwise) will be governed by the laws of the State of New York, without reference to its conflicts of law principles and will be brought exclusively in the state and federal courts located in Paris, France, and each entrant accepts and submits to the personal jurisdiction of these courts with respect to any legal actions, suits or proceedings arising from or relating to this Contest or these Terms. 

1. Privacy 

Wizz may collect personal data about Participants and use such data in accordance with the Privacy Policy published at https://www.wizzapp.info/privacy. Personal data of the Participant may be disclosed by Wizz to any third party and at the request of any official authorities as described in the Privacy Policy. By entering into the contest, you agree that you have read and accepted our Privacy Policy.
